Handling specific instances

What is a specific instance?
It's a complaint submitted to the NCP due to a breach or missapplication of the Guidelines by a multinational enterprise. NCPs will offer good offices, mediating as an extrajudicial mechanism with the goal of achieving a consensus between the parties.
Any institution, individual or legal person can submit a specific instance to the Spanish NCP. The request must include:
  • The identity of the claimant.
  • Point or points of the Guidelines that have been breached, an explanation of the facts that justify the claim as well as any evidence.
  • A request to iniciate a good offices process with the aim of achieving a consensuated solution of the problem.
  • Claims by the claimant.

Once the specific instance has been submitted, its consideration is composed of three phases:
  • Phase 1 - Initial Assessment: to determine if the issues raised merit further examination.
  • Phase 2 - Offer of Good Offices: to seek advice and facilitate access to consensual an non-adversarial means to resolve the issues.
  • Phase 3 - Conclusion: to issue statements or reports.
